  • Classical Philosophy distinguishes six kinds of “love” relevant to our model of Marriage - Romantic Love being just one kind.
    • (1) Passionate Love [Eros] entails sexual “Romantic Love”
    • (2) Playful, Uncommitted Love [Ludus] entails fun and/or conquest - with no strings attached
    • (3) Friendship [Philia] entails mutual good will
    • (4) Familial Love [Storge] is like Friendship, but rooted in dependency, familiarity, and our identity (rather than qualities)
    • (5) Practical Love [Pragma] is founded on reason, duty, and long-term interests
    • (6) Universal Love (e.g. of strangers) [Agape] is unselfish, altruistic concern for welfare of other [generally]

United States Supreme Court (SCOTUS) Opinion, OBERGEFELL v. HODGES - 

  • Four principles and traditions demonstrate that the reasons marriage is fundamental under the Constitution -

1. personal choice regarding marriage is inherent in the concept of individual autonomy;
2. a two-person union unlike any other in its importance to the committed individuals;
3. it safeguards children and families and thus draws meaning from related rights of childrearing, procreation, and education;

  • (a) Without the recognition, stability, and predictability marriage offers, children suffer the stigma of knowing their families are somehow lesser. 
  • (b) They also suffer the significant material costs of being raised by unmarried parents, relegated to a more difficult and uncertain family life.
  • (c) Precedent protects the right of a married couple not to procreate, so the right to marry cannot be conditioned on the capacity or commitment to procreate.
